GENERAL PURCHASING CONDITIONS
These general purchasing conditions regulate the use of the website www.flsida.org/tienda-fls (from now on "THE SHOP"), owned by the Fight AIDS Foundation (from now on “FLS”). FLS is a non-profit private foundation located at the Germans Trias Hospital.
http://www.flsida.org/tienda-flsThe use by the customer of THE SHOP implies, in any case, adherence to the general purchasing conditions published by FLS in the purchase order. Therefore, the customer should read these general conditions before proceeding to make a purchase.
1. Scope of the contract
These general conditions of purchase apply to the sale of all FLS items through its website to consumers who can receive orders in Spanish mainland. The FLS reserves the right to cancel a user's order if fraudulent, speculative or bad faith acts are detected in the use of this service.
If you want to buy a product from outside the Spanish mainland, you can contact us at email@example.com and we will send you instructions on the procedure to follow.
The applicable prices are those indicated on the website on the date of the order. The prices are detailed in each article and include I.V.A. (taxes). The amount of the shipping costs is indicated to the customer at the time the command is made. The FLS reserves the right to make, at any time and without prior notice, the appropriate modifications, being able to update, even daily, items and prices depending on the novelties that appear.
The payment method will be selected during the purchase process and the payment itself, according to the chosen form, will be made at the end of the purchase process and will be an indispensable condition for its formalization. Payment methods accepted are credit card or Paypal.
In any case, the payment method is chosen during the purchase process on the corresponding screen. The client must notify FLS, by email or by telephone in the shortest term so that he can make the necessary arrangements, any improper or fraudulent charges made on the card used for purchases. Suppliers or issuers of payment methods may adopt anti-fraud measures that entail the rejection of certain types of operations. The FLS is not responsible for the application of this type of security policy.
4. Delivery and shipping
All the products offered in THE SHOP are available (except stock breaks or exceptional cases). Thus, orders are processed so that they are delivered within a period of 2 to 3 business days from the reception of the Order confirmation email. Orders received on Fridays or holidays will be processed the first following business day. If, for any reason, there is a delay in the order, we would notify you the estimated delivery time.
Shipments are made by the courier company MRW. Shipping costs are fixed and are valued at € 5.86 when the package does not exceed 5 kg in weight or 100 cm in length. If the package exceeds these dimensions, the FLS would contact the buyer to agree on the economic conditions of the shipment.
It is not possible to specify the exact time of delivery.
If the package could not be delivered and was returned by the courier agency because of the inability to contact the customer, the customer would be responsible for paying for the new shipment.
If there is any mistake in the order received, contact us via e-mail (firstname.lastname@example.org) and we will inform you about how to solve it at no cost.
6. Returns. Right of withdrawal.
If, for any reason, you are not satisfied with the purchased product, you have a period of 14 days, from the date of delivery of the product, to return it.
To exercise the right of withdrawal, you will have to notify us of your decision to withdraw from the contract through an unambiguous statement (for example, a letter sent by mail, fax or email).
In case of withdrawal, we will refund all expenses received that have been your responsibility, including shipping costs. We will proceed to make the aforementioned refund using the same payment method that you used in the initial transaction, unless you have expressly provided other instructions. In no case will you incur any expenses as a result of the reimbursement.
We are not responsible for packages that do not reach us for losses or other reasons, so we advise you to use certified mail or some type of messaging with which you can certify the delivery of the package. In order to accept the return, the product will have to be in perfect condition. The customer will have to make a correct packaging that ensures its transport without damage. Once received and verified by our staff that the product is in the same state in which it was sent, the amount will be refunded.
7. Availability of items
All purchases are subject to product availability. If there are incidents regarding its supply or if there are no products in stock, the customer will be informed immediately and the amount of the product or products without stock will be refunded. The FLS will reimburse the corresponding amount within 14 days. The refund will be made by the same payment method with which the payment was made.
8. Warranty of purchased items
The contractual guarantee offered is that established in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Customers and Users. The FLS will respond to any lack of conformity manifested within two years of the delivery of the product, and provided that the client has informed the FLS of the aforementioned lack of conformity within two months of being aware of this.

10. Applicable Law and Jurisdiction
These General Purchase Conditions are subject to Spanish legislation. The parties submit, at their option, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of Barcelona.
